Submitting an application does not guarantee approval or funding.

3. Information Accuracy

All information you provide must be true, accurate, and complete. Providing false or misleading information may result in rejection of your application, termination of any existing funding arrangement, or legal action. You are responsible for promptly updating any changes to your information.

4. Funding Terms & Fees

If approved, you will receive a separate written funding agreement that outlines the specific terms and conditions of your funding, including applicable rates, fees, and repayment schedule. Fees may include origination fees, processing fees, NSF fees, late payment fees, or other administrative fees as permitted by applicable law. All material costs and terms will be disclosed before you accept any funding offer.

5. Repayment Obligations

You agree to repay all amounts owed according to the terms set forth in your funding agreement. You must maintain sufficient funds in your designated bank account for scheduled withdrawals. If you anticipate difficulty making a payment, you agree to notify Merchant Fund Express promptly to discuss available options.

6. Default & Collections

Failure to make payments as agreed may result in one or more of the following actions:

• Assessment of late fees and penalties
• Acceleration of the full outstanding balance
• Reporting of delinquency to credit bureaus
• Referral to third-party collection agencies
• Legal action to recover amounts owed

In the event of default, you agree to pay all reasonable costs of collection, including attorney fees and court costs, to the extent permitted by applicable law.

You agree to use our website for lawful purposes only. You may not:
